Permits for your market in Newark, NJ.

To run a vendor market in Newark, an organizer applies through the city's online Special Events portal when the event uses city property, vendors register with the New Jersey Division of Taxation for a Certificate of Authority, and the city licenses businesses through its Office of Central Licensing and Permits. Confirm food permits with the health department.

Event permit.

Special Event permit and Block Party permit

Applications go through the city's online permit portal after creating an account. Commercial vendor markets on public streets or property fall under the special event or festival track rather than the block party track.

A special event is any organized activity wholly or partly on City of Newark property that needs city services. A block party is a non-commercial neighborhood event on a residential street; a block party with a commercial nature is treated as a festival instead. The portal does not say whether events held only on private property need a permit.
Timing
Block parties: at least 21 days (3 weeks) before the start date; no lead time stated for other special events

Business registration (Form NJ-REG) and Certificate of Authority for sales tax

Vendors register online with Form NJ-REG and receive a New Jersey Certificate of Authority, which must be displayed at the table, stand or vehicle where they sell. Registered sellers then collect and remit sales tax; the Division's page gives the state rate as 6.625%.

Your duty

What the rules ask of you about vendors.

New Jersey's flea market publication tells operators to inform every vendor using their space to sell taxable goods that the vendor must register with the state and collect and remit sales tax, and that vendors must display their Certificate of Authority. Space rent alone is not taxable, but rent that includes equipment such as tables is. Promoters of ticketed events have the separate admission tax duty listed above. Official page
